The rules for playing every Farm Fury game, making purchases in them, and using farmfurygames.com, in plain language. Paired with our Privacy Policy rather than repeating it.
These Terms of Use ("Terms") govern your use of every game published by Tenbucks Mobile (PTY) Ltd ("we", "us") under the Farm Fury name, on any platform, currently Farm Fury: Arcade (com.farmfury.arcade), Farm Fury, and Farm Fury: Stampede, and any future Farm Fury game that links to this page (each a "Game", together the "Games"), as well as our website, farmfurygames.com.
By downloading, installing, or playing a Game, or using the website, you agree to these Terms. If you don't agree, please don't use them.
A Game may have extra rules that apply only to it (for example, for a feature only that Game has). If so, the Game or its store listing will show them, and they apply alongside these Terms. Our Privacy Policy covers what the Games store and which outside services they use.
The Games are made for a broad family audience, including children, and every session is treated as directed to children for advertising purposes (see the Privacy Policy). If you are old enough where you live to agree to terms like these, you confirm that by using the Games. If you are not, or if a child uses your device, a parent or guardian should review these Terms and supervise the child's use, particularly purchases.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use each Game on a device you own or control, for your own personal, non-commercial entertainment. This license gives you no ownership of any Game, its code, or its content.
You may not copy, modify, decompile, reverse-engineer, distribute, or create derivative works from any Game, except where the law gives you that right despite this restriction. Your use of a Game is also subject to the terms of the app store you got it from.
The Games are free to download and may offer optional real-money purchases such as coin packs, ad removal, cosmetic items, and extra worlds or content. Every purchase is billed by, and refunded through, the Apple App Store or Google Play using the payment method on your account there. We never receive your card details and do not process refunds ourselves; Apple's and Google's refund policies apply, so please contact them for a refund. This does not affect any rights you have under consumer protection law.
Coins and other in-game items are usable only inside the Game they come from. They have no cash value and cannot be exchanged for money, transferred to another player, Game, or device, or redeemed outside that Game. They are stored on your device, so uninstalling a Game or losing the device can mean losing them. One-time (non-consumable) purchases, such as ad removal or a cosmetic item, can usually be restored through the Game's Restore Purchases option or the app store; consumable items such as coins cannot.
Purchase screens in the Games show a short challenge before a purchase can go ahead, to stop young children buying things by accident. It is not age verification and does not replace a parent's own decisions about purchases on a shared device. You can also turn off or restrict in-app purchases in your device or app-store settings.
The Games may show ads served through the providers named in the Privacy Policy. Watching a rewarded ad is always optional. Where a Game sells ad removal, it removes the ads that interrupt play; optional rewarded ads may stay available afterwards because you choose whether to watch them. What each Game's ad removal covers is described in that Game.
When you use a Game or the website, please don't:
If a future Game adds features that let players interact with each other, that Game will set out any extra rules of behaviour before those features go live.
The Games and the website, including their characters, art, music, sound, code, and the Farm Fury name and brand, are owned by Tenbucks Mobile (PTY) Ltd or its licensors and are protected by copyright, trademark, and other laws. The license in section 03 lets you play the Games. It does not give you any right to use Farm Fury characters, art, or branding anywhere else (for example in your own content, products, or merchandise) without our written permission.
farmfurygames.com provides information about the Games and links to where you can get them. Farm Fury merchandise is sold outside the Games; nothing physical is sold inside a Game. Merchandise orders, payment, delivery, and returns are covered by the terms shown on the store page where you buy, and your consumer rights under the law apply.
The Games rely on outside services, including ad mediation, ad networks, analytics, and the app stores, and may link to other websites. Each operates under its own terms and privacy policy (see our Privacy Policy). We are not responsible for their conduct, availability, or content.
TO THE EXTENT THE LAW ALLOWS, THE GAMES AND THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT ANY GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF LOST PROGRESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENBUCKS MOBILE (PTY) LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF ANY GAME OR THE WEBSITE, INCLUDING LOST PROGRESS OR LOST VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A GAME WILL NOT EXCEED THE AMOUNT YOU PAID FOR PURCHASES IN THAT GAME IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places do not allow these limitations, so some of the above may not apply to you. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
The Games have no accounts, so there is no account for us to suspend. We may stop supporting, updating, or distributing a Game, or a feature of it, at any time. Copies already downloaded may keep working until your device or app store no longer allows it. You can stop using a Game at any time by uninstalling it.
We may update the Games (new content, fixes, balance changes), release new Games, and update these Terms. When we make a material change to these Terms, we update the version number and effective date at the top of this page. Continuing to use a Game or the website after a change takes effect means you accept the updated Terms.
These Terms, and any dispute arising out of or in connection with them or your use of the Games or the website, are governed by the laws of the Republic of South Africa. If you are a consumer living in another country, you keep any protections the law of that country gives you.
